Privacy Policy

This Privacy Policy explains what information Eagle Nest Property Group LLC ("Eagle Nest," "we," "us," or "our") collects through eaglenestpg.com (the "Site"), how we use it, and the choices you have. By using the Site, you agree to the practices described here.

Information We Collect

We collect information in 3 ways:

Information you provide to us

When you submit our contact form or email us, we collect the details you choose to share. Typically your name, company, email address, phone number, the nature of your inquiry, and any message content. You control what you send. Please don't include sensitive personal information you don't want us to have.

Investor inquiries collect your name, email, and any investment interests you choose to share. If you request a property flyer and availability updates, we use your name and email to respond and send those updates. You can ask us to stop updates at any time by replying or emailing team@eaglenestpg.com.

Agreements, data rooms, and document uploads

When you sign a confidentiality or brokerage agreement through the Site, we collect the details you enter (your name, company, title, email, phone, and license number where relevant), a one-time code we email you to confirm your address, your typed or drawn signature, and an audit record of the signing (date and time, IP address, and device and browser type). We use this record to prove the agreement was signed, email you a signed copy, register you with a listing broker where the agreement allows it, and give you access to the matching data room. When you open a data room file, we record which file you opened and when. If you upload documents or share your buying criteria, we keep them to evaluate and market properties for you and to match you with opportunities. Signed agreements and uploads are stored with our website host (Cloudflare) and our document storage provider (Dropbox), and emails are sent through our email provider (Resend).

Information collected automatically

Like most websites, our hosting and security provider may automatically log technical data such as your IP address, browser type, device information, referring page, and the pages you view. This helps us keep the Site secure, reliable, and performant.

Cookies and similar technologies

The Site uses a minimal set of cookies and similar technologies necessary for core functionality and security, including a secure cookie that keeps you signed in to a data room you have been given access to. We do not use the Site to build advertising profiles. You can control or block cookies through your browser settings. Some features may not function correctly if you disable them.

How We Use Your Information

• To respond to your inquiries and provide the information or services you request
• To discuss brokerage, development, consulting, or investment opportunities you raise
• To operate, maintain, secure, and improve the Site
• To comply with legal, regulatory, and professional obligations, including those of the Texas Real Estate Commission
• To protect our rights, property, and the safety of others

How We Share Information

We do not sell your personal information. We share information only as needed to operate our business:

• Service providers who support the Site and our operations, for example our website host and form processor (Cloudflare), document storage (Dropbox), transactional email (Resend), mapping services (Google Maps), and email and productivity tools, under obligations to protect your information
• Professional and legal compliance, where required by law, regulation, subpoena, or to enforce our agreements
• Business transfers, in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy

Third-Party Services and Links

The Site embeds and links to third-party services, including Google Maps, downloadable marketing materials, and the websites of our sister ventures. Those services operate under their own privacy policies, and we are not responsible for their practices. We encourage you to review them.

Data Retention

We keep inquiry and contact information for as long as needed to respond to you, maintain our business relationship, and meet legal, tax, and recordkeeping obligations, after which we delete or de-identify it. Signed agreements and their audit records are kept for at least as long as the agreement and any obligations under it remain in effect, and as long as Texas real estate recordkeeping rules require.

Data Security

We use reasonable administrative and technical safeguards, including encrypted (HTTPS) transmission, to protect information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

Your Privacy Rights

Depending on where you live, you may have rights to access, correct, delete, or obtain a copy of your personal information, and to opt out of certain uses. To exercise any right, contact us using the details below. We will respond consistent with applicable law.

Texas residents

Under the Texas Data Privacy and Security Act (TDPSA), Texas residents may have the right to confirm whether we process their personal data, to access, correct, or delete it, to obtain a portable copy, and to opt out of the sale of personal data or targeted advertising. We do not sell personal data or engage in targeted advertising. If we decline a request, you may appeal by replying to our decision. If an appeal is denied, you may contact the Texas Attorney General.

Children's Privacy

The Site is intended for a business and professional audience and is not directed to children under 13. We do not knowingly collect personal information from children.

Changes to This Policy

We may update this Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be reflected on this page.
